The land lies at approximately 265m above mean sea level and is classified as Severely Disadvantaged for BPS purposes.
Method of Sale
The Vendors and sole selling Agents reserve the right to alter or divide the property or to withdraw or exclude any of the property at any time.
The Vendor(s) reserves the right to vary any of the terms and conditions of sale or to change the method of sale without notice. Money Laundering Obligations
As part of the new Money Laundering Regulations (The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017) relating to property transactions the Selling Agents are obliged to carry out Customer Due Diligence checks on any Purchaser prior to a transaction being completed.
The land is offered for sale freehold with vacant possession upon completion.
Completion is set for 16th October 2019. Early completion may be possible by negotiation with the Vendor.

Wayleaves, Easements, Covenants & Rights of Way
The property is sold subject to all rights including rights of way, whether public or private, light, support, drainage, water and electricity supplies and other rights and obligations and easements, quasi easements and restrictive covenants and all existing and proposed wayleaves for masts, pylons, stays, cables, drains, and water, gas and other pipes, whether or not referred to in these particulars.

Sporting & Mineral Rights
The sporting rights insofar as they are owned by the Vendors are included within the sale. The mineral rights are excluded from the sale as they are outwith the ownership of the Vendor.
Basic Payment Scheme (BPS)
The land at Scalehouses falls partially within the Severely Disadvantaged Area and partially outwith the Severely Disadvantaged Area for BPS Purposes. An application has been successfully made to establish and activate Entitlements under the Single Farm Payment Scheme and these have transferred to the BPS.
A claim has been submitted under the BPS in 2019 and the Vendor will retain the entirety of the 2019 BPS monies.
The Entitlements for the land are included within the sale and are as follows:
Lot 1: 0.62 SDA Entitlements
The transfer of Entitlements will be made upon completion of the sale and in time for the Purchaser to utilise them for BPS purposes in 2020. It is the responsibility of the successful Purchaser to ensure that they are eligible to acquire Entitlements under the terms of the BPS. The transfer will be made in accordance with the regulations of the scheme and will be carried out by PFK Land Agency for a fee of £200 plus VAT which will be payable by each transferee. Any transfer will be undertaken as soon as BPS rules and regulations permit.
A copy of the 2019 BPS application will be available for inspection at the offices of the Selling Agents by prior appointment.
The Purchaser will be required to comply with the terms of the Vendor's BPS application in 2019 and will indemnify the Vendor against any breaches of the conditions, particularly in respect of Cross-Compliance.
Quotas & Countryside Stewardship Schemes
For the avoidance of doubt there are no livestock quotas or milk quotas included in this sale.
The land is not entered into any form of Environmental Stewardship Scheme.
Fixtures & Fittings
All fixtures and fittings referred to in these particulars will be included in the sale unless otherwise stated.
Measurements are approximate and have been taken from the Rural Land Registry maps but they must not be relied upon and any Purchaser must satisfy themselves with regard to areas.
The land is classified as Grade 4 under the former MAFF Land Classification System.
As far as the Vendors are aware the responsibility for the boundaries are shown on the sale plan by inward facing ‘T’ marks. When no mark is shown no further information is available.

The plans attached to these particulars are based on Ordnance Survey National Grid and are for reference only. Purchaser(s) will have deemed to have satisfied themselves of the nature of the land and schedules.
